Welcome to Safe In Seconds. These Terms of Service apply to your use of the Safe In Seconds website and the purchase of products from us.

Safe In Seconds is operated by Safe In Seconds Pty Ltd (ABN 34 700 242 477) ("Safe In Seconds", "we", "us" or "our"). Our online store is powered by Shopify.

These Terms of Service should be read together with our Privacy Policy, Shipping & Delivery Policy and Returns & Refunds Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

SECTION 2 – OUR PRODUCTS

We make every reasonable effort to ensure product descriptions, images and other information on our website are accurate.

Colours and appearance may vary slightly depending on your screen, device settings, lighting and normal manufacturing variations.

Product descriptions, availability and specifications may be updated from time to time. We may also discontinue products or limit quantities where reasonably necessary.

Nothing in this section limits any rights you may have under the Australian Consumer Law, including consumer guarantees relating to acceptable quality, fitness for purpose and correspondence with description.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase the products in your order. We reserve the right to accept or decline an order, including where a product is unavailable, there is an obvious pricing or listing error, or we reasonably suspect fraudulent activity.

Payment must be successfully authorised before an order can be processed.

Please review your order carefully before submitting it. Because we aim to dispatch orders quickly, we cannot guarantee that an order can be changed or cancelled after it has entered the packing process.

Returns and refunds are handled in accordance with our Returns & Refunds Policy, in addition to any rights or remedies available under Australian Consumer Law.

SECTION 4 – PRICES AND BILLING

Unless otherwise stated, prices displayed on our Australian store are in Australian dollars (AUD).

Any applicable shipping charges will be displayed before you complete your purchase.

For international orders, customers may be responsible for customs duties, import taxes or other charges imposed by authorities in the destination country. These charges are outside our control unless we expressly state otherwise.

Prices, promotions and discounts may change from time to time. The price applicable to your purchase will be the price shown when your order is placed, subject to correction of obvious errors.

SECTION 5 – SHIPPING AND DELIVERY

We aim to dispatch orders promptly in accordance with our Shipping & Delivery Policy.

Australian orders are shipped using Australia Post and include tracking. Delivery timeframes shown on our website are estimates and may occasionally be affected by carrier delays, public holidays, severe weather or other circumstances outside our reasonable control.

If your order is delayed, missing or appears to have been delivered incorrectly, contact support@safeinseconds.com and we'll help investigate.

SECTION 16 – DISCLAIMER OF WARRANTIES

To the maximum extent permitted by law, we do not guarantee that the website or its online functionality will always be uninterrupted, error-free or available.

However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law where it would be unlawful to do so.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

SECTION 17 – LIMITATION OF LIABILITY

To the maximum extent permitted by law, Safe In Seconds will not be liable for indirect, incidental, special or consequential loss arising from your use of the website where such liability may lawfully be excluded.

Nothing in these Terms excludes, restricts or modifies any liability, consumer guarantee, right or remedy that cannot lawfully be excluded or limited, including rights under the Australian Consumer Law.

SECTION 18 – INDEMNIFICATION

You agree to indemnify Safe In Seconds, its officers, employees, contractors and service providers against reasonable losses, liabilities, claims and legal costs arising directly from your unlawful use of the Services, your material breach of these Terms, or your infringement of the rights of another person.

This section applies only to the extent permitted by applicable law.

SECTION 22 – GOVERNING LAW

These Terms of Service are governed by the laws of New South Wales, Australia and applicable Commonwealth laws of Australia.

You and Safe In Seconds submit to the jurisdiction of the courts of New South Wales and Australia, subject to any rights you may have under applicable consumer protection laws.
